Who you are dealing with
Firmpoint is built and run by Rumman Khan. When this page says "we", that is who it means. If Firmpoint becomes a company, that company takes over these terms in his place, and we will tell you when it does.
Who Firmpoint is for
Firmpoint is for businesses. You may use it only for your firm's work, and by using it you confirm that you are allowed to accept these terms for your firm.
What Firmpoint does, and what it never does
Firmpoint reads the paperwork your firm already receives. On the buying side, it puts quotes, invoices and delivery notes into one record, compares suppliers, routes an order for approval, and hands the approved order to your ERP. On the estimating side, it reads a tender's drawings and documents, takes off the quantities and prices the lines, and shows where each number came from. Three things it never does, and these are promises, not settings:
- It never replaces your systems. Your ERP stays your ERP. We read and hand back. We do not rip anything out.
- It never moves your money. Everything up to payment happens in Firmpoint. Paying your suppliers stays with your bank and your ERP. We never hold money meant for your suppliers, and we never make a payment for you.
- It never takes money from your suppliers. No commission, no rebate, no paid placement, no fee for being listed. A comparison you see is the comparison your own quotes produced. We are paid by you, never by them.
Paying for Firmpoint
Firmpoint runs on credit your firm buys in advance, and the app shows the price before you pay. Payments are taken by our payment provider, which may appear as the seller on your receipt. Credit is used up as your team uses Firmpoint. Credit you pay for can be used for 12 months from the day you buy it. After that, what is left of it ends. If we stop running Firmpoint, we pay back the credit you paid for and have not used. If you think you were charged wrongly, write to us and we will look at it.
What a page costs, how the free starting credit works and how a top-up is sized are on the pricing page, which is part of these terms. When credit is paid back as money, and when it is not, is set out on the refund page, which is part of these terms too.
Early access
Firmpoint is in early access, firm by firm. That means two honest things. First, joining the list is not a promise of a date. Second, while your firm is in early access, features change, and a screen you use this month may look different next month. We aim to tell you before anything you depend on changes.
Your account and your team
You are responsible for who on your team you give access to, for what they do in your account, and for keeping your sign-in details to yourself. Tell us if you think someone else has got into your account and we will help you shut it down. Do not let anyone use your account for work that is not your firm's.
Your firm's data stays your firm's
The documents you connect or upload belong to your firm, not to us. We use them to run the product for you and for nothing else. We do not sell them, we do not show them to other firms, and we do not use your firm's data to train AI models. What Firmpoint learns about how your firm works stays with your firm. What we collect and how we handle it is set out on the privacy page, which is part of these terms. You can take your data out in a normal format at any time, and you can ask us to delete it.
You are responsible for what you put in: that your firm has the right to share it with us, including any personal information inside it.
What you agree not to do
- Do not upload documents you have no right to, and do not connect a mailbox or a WhatsApp number your firm does not control.
- Do not try to break in, overload the service, or take it apart to copy it.
- Do not use Firmpoint to do anything illegal, or to handle anyone's personal information in a way the law where you work does not allow.
If any of that happens we may pause the account, and we will tell you why. If someone makes a claim against us because of something your firm put in without the right to, your firm is responsible for that claim and for our reasonable costs of dealing with it.
What we do not promise
Firmpoint reads documents with AI and shows you what it found. It can be wrong. Every value it pulls out keeps a link to the document it came from so your team can check it, and your team confirms the numbers before they are trusted. Every quantity, rate, price and total Firmpoint produces, in an estimate, a comparison or an order, is for your team to check before you rely on it. The decision to submit a tender, place an order or pay an invoice, and everything that follows from it, stays yours.
The website and the demo use made-up firms and example numbers. Nothing on them is advice. We provide Firmpoint as it is. We cannot promise it is never down or never makes a mistake, and we do not promise any particular result for your firm. During early access there is no uptime guarantee.
If something goes wrong
We are not responsible for lost profit, lost revenue, lost contracts or tenders, lost business, or any loss that was not a direct and foreseeable result of what we did. We are not responsible for delays or failures caused by things outside our reasonable control, such as an outage at a provider we rely on, or a change made by Google, Meta or the maker of your ERP.
For anything else, the most you can claim from us, in total, is what your firm paid us in the twelve months before it happened. Nothing here limits anything the law does not allow to be limited, such as responsibility for fraud, or for death or injury caused by negligence, and nothing takes away a right the law gives you and will not let you sign away.
Stopping
You can stop whenever you like. Disconnect your mailbox or your WhatsApp number in Settings, take your data out, and tell us to delete the rest. We can end an account too, and other than the serious cases above we give you notice first and time to get your data out.
Disputes and the law
If something is wrong, write to us first and we will try to put it right. These terms are governed by the law of England and Wales, and its courts deal with any dispute about them. If a court decides part of these terms cannot apply, the rest still does. If we do not act on something straight away, we can still act on it later.
Changes to this page
If we change these terms in a way that matters, we say so here with a new date at the top, and we tell firms already using Firmpoint before it takes effect.
